Adam Iliou, senior associate, and Dimitris Andriopoulos, associate, members of our Dispute Resolution practice, recently represented an energy community and four other companies, developing small-scale solar PV projects in Western Greece. They successfully defended against a temporary order request filed before the Agrinio Single-Member Court of First Instance.

This case is part of a recent trend where local communities resort to civil courts in an attempt to block the development and continuation of construction works for RES projects, alleging infringement on their absolute “right to personality” due to perceived environmental licensing inadequacies. By distinguishing this case from a previous one where a different court had ruled in favor of the local community, our team convinced the Court to allow the projects to continue their development and construction.

This decision, while part of a larger ongoing dispute, is a positive step for our clients and demonstrates our team’s experience in handling novel complex disputes.
